TOUR PACKAGE

1. BINDING AGREEMENT AND ACKNOWLEDGMENT

By settling any payment, security deposit, or downpayment, the Client expressly acknowledges having read, understood, and agreed to be bound by these Terms and Conditions.
Full payment is mandatory for flights, tickets, and specific services as defined by the Company.

Upon acknowledgment of the quotation/invoice the booking is final and irrevocable.

2. PAYMENT TERMS AND PENALTIES

  • Deadlines: Full payment is due upon visa release or fifty (50) days before departure, whichever occurs first.
  • Forfeiture: Failure to meet payment deadlines results in the automatic release of the slot and total forfeiture of all deposits.
  • Monthly Installments: Remaining balances must be settled in equal monthly installments prior to the deadline.
  • Late Surcharge: Any payment made beyond the monthly due date is subject to a mandatory surcharge of P1,000 per pax.
  • Final Cut-off: If full payment is not received forty-five (45) days prior to departure, all deposits are forfeited as liquidated damages.

3. CANCELLATION AND REFUND POLICY (LIQUIDATED DAMAGES)

  • Non-Refundability: The entire tour package cost is strictly non-refundable and non-rebookable.
  • Unused Services: No refunds or credits shall be provided for unused tours, transportation, hotel stays, or flights for any reason.
  • Immediate Forfeiture: Once a guarantee deposit is made, cancellation is prohibited, and all funds are forfeited.
  • Immigration Issues: If a passenger is denied departure by Philippine Immigration or entry by a foreign country, the package remains 100% non-refundable.

4. AGENCY DISCLOSURE AND LIMITATION OF LIABILITY

  • Independent Suppliers: The Company acts only as an intermediary/agent for airlines and hotel operators.
  • Force Majeure: The Company is not liable for losses or unused services caused by force majeure, natural disasters, labor disputes, flight delays, or any event beyond its control.
  • Airline Changes: Clients must adhere to any flight schedule adjustments made by the airline; the Company is not liable for such changes.
  • Health Responsibility: Any medical, quarantine, or hospital expenses (including positive RT-PCR/Antigen results) are the sole financial responsibility of the Client.

5. DOCUMENTATION AND VISA COMPLIANCE

  • No Guarantees: The Company provides no assurances or legal guarantees regarding visas, permits, or immigration clearances.
  • Visa Denial: In the event of visa denial, the guarantee deposit is forfeited.
  • Passport Validity: Passengers must ensure passports are valid for at least six (6) months from the last day of travel.
  • Correction Window: Clients have twenty-four (24) hours from document release to report inaccuracies. After this period, details are final and unchangeable.

6. BAGGAGE AND MODIFICATIONS

  • Baggage Responsibility: Travelers are solely responsible for paying excess baggage fees at the check-in counter.
  • Add-on Deadlines: Additional baggage must be requested at least five (5) days before departure.
  • Modifications: Any request for name, date, or destination changes must be made at least forty (40) days prior to departure and is subject to airline approval and fees.

7. DATA PRIVACY, LEGAL PROVISIONS AND VENUE

  • Data Privacy: By settling the deposit, the client expressly consents to the collection, processing, and transmission of personal and sensitive information to relevant third-party service providers as required for the availed services.
  • Attorney’s Fees: If the Company initiates any legal action, the Client shall pay all of the total amount due paid to the attorney.
  • Venue of Litigation: Any legal action arising from this agreement shall be filed exclusively in the courts of the city where the Company’s principal office is located, to the exclusion of all other venues.

VISA ASSISTANCE

1. ACCEPTANCE AND SCOPE OF SERVICE

  • Binding Agreement: Settlement of any payment, account, deposit, or down payment constitutes absolute acceptance of these terms and conditions.
  • Agency Only: The Company acts strictly as a facilitator. The approval, denial, validity period, and number of entries of any visa are the sole prerogative of the respective Embassy/Consulate; the Company provides no guarantees or assurances of success.
  • Compliance: It is the passenger's sole responsibility to comply with laws, passport validity (minimum 6 months), and document requirements of Immigration, Customs, and airlines.

2. FINANCIAL TERMS AND LIQUIDATED DAMAGES

  • Non-Refundability: All deposits and payments for services or packages are strictly non-refundable and non-rebookable.
  • Price Fluctuations: Visa fees are subject to change without prior notice; any increase in fees from the time of deposit to the time of filing must be settled by the client.
  • Additional Fees: * Multiple Entry visa requests or approved Multiple visa incur an additional P550 per person.
  • Changes to travel dates after documents are transmitted incur a P850 re-processing fee per person.
  • Cancellation Penalty: Voluntary cancellation or cancellation due to unfavorable filing dates results in the forfeiture of the deposit and a mandatory P800 per person cancellation fee (Liquidated Damages) will be strictly imposed.
  • Right of Retention: The Company reserves the right to withhold all documents until all outstanding fees and cancellation penalties are settled in full.

3. FILING AND DOCUMENT HANDLING

  • Filing Schedule: Filing dates depend on Embassy availability and are subject to change without notice. The Company is waived from all liabilities if the Embassy changes the filing date.
  • Finality of Submission: Once requirements are completed, the application is final; no documents may be pulled out.
  • Liability Limit: * The Company is not liable for loss of documents outside its premises.

    • For loss inside premises, liability is limited strictly to the cost of re-processing the documents; the Company is not liable for delays or consequential damages.
  • Forfeiture: Failure to submit complete documents by the deadline results in the forfeiture of the deposit.

4. LIMITATION OF LIABILITY AND FORCE MAJEURE

  • Offloading and Entry: The Company is not liable for offloading incidents or decisions by Immigration Officers to refuse entry/departure.
  • Unused Services: No refunds or credits shall be provided for unused transportation, lodging, or tours due to force majeure, natural disasters, flight delays, or the client’s health.
  • Medical Expenses: Clients are solely responsible for quarantine or hospital expenses should they test positive for Antigen/RTPCR during a tour.

5. DATA PRIVACY, LEGAL PROVISIONS AND VENUE

  • Data Privacy: By settling the deposit, the client expressly consents to the collection, processing, and transmission of personal and sensitive information to relevant Embassies and third-party service providers as required for the application.

POCKET WIFI RENTAL

1. RENTAL DURATION AND BOOKING PROTOCOLS

  • Minimum Rental: A mandatory minimum period of three (3) days is required for all bookings.
  • Last-Minute Bookings: Bookings made within twenty (20) days of departure are subject to device availability.
  • Extensions: Requests must be made at least 24 hours before the original return date, subject to availability and additional daily fees.

2. CANCELLATION AND REFUND POLICY

  • Standard Cancellation: Cancellation requests must be sent at least ten (10) days before the travel date.
  • Cancellation Fee: All approved cancellations are subject to a fixed cancellation fee of 25% of the total rental price, which shall be deducted before any refund is issued.
  • Late Cancellation: Requests made less than ten (10) days before the travel date are strictly prohibited, and no refunds shall be granted.

3. SECURITY DEPOSIT (SD) AND FINANCIAL PROTECTION

  • Deposit Amount: A Security Deposit of Php 6,500 is required per unit.
  • Technical Inspection: The SD is refundable only after the device and all accessories have been returned and inspected for functionality and damage.
  • Automatic Deduction: The Company is authorized to deduct any outstanding balances, late fees, or damage charges from the SD.
  • Excess Liability: If total damages or losses exceed the Php 6,500 deposit, the Client agrees to pay the remaining balance within three (3) days of notification.

4. DELIVERY, PICK-UP, AND RISK TRANSFER

  • Office Transactions: No delivery fee applies for direct pick-up and return at the Company office.
  • Bacolod City & Out-of-Town: Deliveries and returns are subject to a per-way delivery fee based on location.
  • NAIA Terminal (Urgent): Delivery via Grab or Lalamove is available for NAIA only. This service is not available for other airports.
  • Transfer of Risk: For third-party deliveries, the Client is responsible for paying the rider directly. Risk of loss or damage passes to the Client upon the Company handing the device to the courier.
  • Acceptance: Failure to report defects upon receipt constitutes an admission that the equipment was received in good, working condition.

5. LOSS AND DAMAGE FEES

  • In the event of loss, theft, or physical damage, the following charges apply:

  • Absolute Liability: The Client’s liability is absolute and shall not be waived due to force majeure, theft, or accidental loss.

6. USAGE AND SERVICE LIMITATIONS

  • Network Performance: While the Company provides high-speed data, signal strength depends on local network providers and geographical limitations.
  • No-Refund for Signal: The Company is not liable for service interruptions, slow speeds, or "dead zones" in the destination country.
